2. Eligibility & restrictions

You are responsible for ensuring that participating in the presale or using $ITW complies with the laws of your jurisdiction. ItalWindows may restrict access from certain countries or regions where regulation requires it.

3. Use of the application

You agree not to misuse the application, attempt to interfere with its operation, or engage in any activity that could harm other users, ItalWindows, or the underlying infrastructure.

7. Presale Structure & Stages

The $ITW presale operates in three distinct stages with progressive pricing:

• Presale Stage: $0 - $500,000 target (0.00002 SOL per ITW token). This stage offers the best pricing with a 50% bonus compared to public launch.
• Early Bird Stage: $500,000 - $1,500,000 target (0.00005 SOL per ITW token). This stage offers a 30% bonus compared to public launch.
• Public Launch Stage: $1,500,000+ target (0.0001 SOL per ITW token). Market price with no bonus.

Stages automatically transition when funding targets are met. The total presale fundraising goal is 105 SOL (approximately $15,750 at current SOL prices, subject to market fluctuations). The presale ends on February 14, 2026 at 09:00 UTC.

8. Purchase Requirements

To participate in the presale, you must meet the following requirements:

• Minimum Purchase: The minimum purchase amount is 0.2 SOL per transaction.
• Volume Bonuses: Larger purchases receive additional bonus tokens based on the following tiers:
  • $100 - $499: 3% bonus
  • $500 - $999: 5% bonus
  • $1,000 - $2,499: 8% bonus
  • $2,500 - $4,999: 10% bonus
  • $5,000 - $9,999: 12% bonus
  • $10,000+: 15% bonus
• Payment Method: Only SOL (Solana) is accepted for purchases. USD prices are calculated dynamically based on live SOL market prices.
• Wallet Connection: You must connect a compatible Solana wallet (e.g., Phantom) to participate.

9. Token Generation Event (TGE)

The Token Generation Event (TGE) will only occur if the presale reaches 100% of its total fundraising goal (105 SOL). This means:

• Tokens will be distributed to all presale participants only after the full 105 SOL target is reached.
• If the presale does not reach 100% completion by February 14, 2026, the TGE will not occur, and all participants will be eligible for refunds as described in Section 10.
• Token distribution timing and method will be communicated through official ItalWindows channels once the 100% goal is achieved.
• All purchased tokens, bonus tokens, and referral rewards are subject to the same TGE conditions.

4. Tokens and risk

Crypto assets are volatile and may lose value. There is no guarantee that $ITW will appreciate in price or that secondary markets will exist. You should only contribute what you can afford to lose.

5. Changes to terms

ItalWindows may update these Terms of Use from time to time. Continued use of the application after changes take effect means you accept the updated terms.

10. Refund Policy

If the total presale fundraising goal (100% of 105 SOL) is not reached by the presale end date (February 14, 2026), all participants will be eligible for a full refund of their investment:

• Refunds will be processed in the same currency used for the original purchase (SOL).
• Refund processing will begin within 30 days after the presale end date if the 100% goal is not met.
• Refunds will be sent to the wallet address used for the original purchase.
• No fees will be deducted from refunds - participants will receive 100% of their original investment amount.
• If the 100% goal is reached, no refunds will be available as the TGE will proceed.
• Refunds apply only to purchased tokens, not to referral rewards or challenge rewards.

11. Referral Program Terms

The referral program is subject to the following terms:

• Referral Reward: Referrers earn a fixed reward of 2,500 ITW tokens for each confirmed referral. This is a static amount per referral, regardless of the purchase amount made by the referred user.
• Verification Requirement: To prevent abuse and bot activity, all referred users must hold ITW tokens in their wallet to be verified as valid referrals. Referrals without ITW token holdings will not be counted.
• Referral Rewards: Referral rewards must be claimed through the challenges system. Rewards are subject to the same TGE conditions as purchased tokens.
• Self-Referral Prevention: Users cannot refer themselves. Attempts to use one's own referral code will be automatically detected and rejected.
• Abuse Prevention: ItalWindows reserves the right to invalidate referral rewards if abuse, fraud, or manipulation is detected.

12. Transaction Verification

All transactions are verified on-chain before tokens are credited to your account:

• Transactions must be confirmed on the Solana blockchain before tokens are awarded.
• Transaction verification may take a few seconds to several minutes depending on network conditions.
• Only verified transactions with the correct recipient address and amount will be credited.
• Failed or rejected transactions will not result in token credits or refunds of network fees.
